Companies sue county for breach of contract

Two companies suing the Boone County Commissioners over an alleged breach of contract have requested and received a new trial date.

Calumet Civil Contractors Inc. and Valenti-Held Contractor/Developer, Inc., both of Whitestown, sued the commissioners on April 9, 2010, alleging the county breached a contract for paving and other work in phase 2B of the Anson development in Whitestown. Valenti-Held, the primary plaintiff, is asking for $239,500 plus costs, interest, post-judgment interest and unspecified “other relief.”

A trial was to have begun Sept. 25, but on Aug. 29, the trial was postponed to next year.

Calumet and Valenti-Held want $184,720 to cover the increase in liquid asphalt prices; $54,733 to cover the increase in fuel costs, and $12,745 from cost increases in “errors, mistakes, discrepancies, omissions and/or defects in the engineering plans and specifications provided by the county.”
