County seeks injunction to block Fayette dirt dumping

---- — County officials will ask a judge to formally order a Brownsburg couple to stop spreading fill dirt on a farm field just off Indiana 267 in Fayette.

Robert C. and Susan J. Blackford own the field at 3401 E. CR 750 S., just east of Ind. 267, Boone County attorney Bob Clutter said in a court motion asking Superior Court II Judge Rebecca McClure to order the couple to stop allowing the delivery of dirt to the site. Clutter is also asking that McClure fine the Blackfords up to $300 a day and require them to pay unspecified damages.

A hearing on the injunction request is scheduled for 3:30 p.m. May 30.

The Blackfords are in violation of the county's zoning and drainage ordinances, and are maintaining a common nuisance, Clutter said in his motion.

The county alleges that the Blackfords, or their employees, have intentionally destroyed two stop-work orders issued to them by the Boone County Area Plan Commission, Clutter said.
