Wal-mart coming back to commission

The furor over Wal-Mart will soon return to the Zionsville Plan Commission.

Wal-Mart attorney Alan Townsend said neither Wal-Mart nor the plan commission appealed the decision made by Hamilton County Superior Court I Judge Steve Nation.

Nation issued a decision March 28 overturning the plan commission’s claim it can’t hear the Wal-Mart petition because it did not have jurisdiction. The commission said it could not rule on Wal-Mart’s plans because a portion of project was in Hamilton County and a portion in Boone County. The 30-day deadline to appeal the decision passed last week, Townsend said.

ZPC President Lana Funkhouser did not return a call for comment.

Townsend doesn’t know when the plans will go before the plan commission again, but it should be soon.

“The lawyers that have been litigating this will fade off to the side, and the real estate folks will start working together again,” Townsend said.
