Trial dates set for Waters

An Indianapolis man charged with five felonies, including attempted rape, pleaded “not guilty” at his arraignment hearing Tuesday, Sept. 23.
Antonio Waters, 23, was arrested early Sunday morning, Sept. 21, for allegedly sexually assaulting a 25-year-old Zionsville woman at her home. He was charged with attempted rape, criminal deviant conduct, battery, criminal confinement and strangulation.
He is still being held in the Boone County Jail on a $50,000 bond.
His case will be heard in the Boone County Circuit Court; Larry Giddings is his assigned counsel. With his not guilty plea, Waters will have a pre-trial hearing on Nov. 25, where the prosecution will introduce evidence and possibly hear police testimony.
Unless Waters changes his plea to guilty or enters into a plea bargain at the pre-trial hearing, he will have a jury trial beginning Jan. 12, 2009 in circuit court.
Police reports say the victim allegedly brought Waters to her Zionsville home early on Sept. 21, where he quickly sexually assaulted her. After a struggle in which the victim sustained injuries to her face and neck, she managed to escape and run to a neighbor’s home to call the police.
Zionsville Police Det. Charles White of the Criminal Investigations Division said Waters had either passed out or blacked out when police arrived at the victim’s home. Tests showed he had a blood alcohol content of .13.
Attempted rape and criminal deviant conduct are both Class A felonies, which carry penalties of 20 to 50 years in jail. Criminal confinement is a Class B felony, carrying a penalty of six to 20 years in jail. Battery, a Class C felony, could have a penalty of two to eight years in jail, and the Class D felony strangulation carries a penalty of a half-year to three years in jail.
