---- — The 2008 lawsuit between Wal-Mart and Zionsville has finally had a new development.
Valorie Hahn, a Hamilton County pro tempore judge for Judge Steve Nation, ordered mediation for the two sides in a court order dated Thursday, June 27. The lawsuit concerns a 2008 decision by the plan commission to deny development plan approval and subdivision plat approval.
Wal-Mart filed new plans with the town, which were denied during a February meeting by the Board of Zoning Appeals. Alan Townsend, who is representing Wal-Mart, said the February ruling has nothing to do with the lawsuit or the latest action.
According to the order, the matter came before the court for a pretrial conference on Wednesday, June 26.
“We had a status conference that day in front of Judge Nation, which is a normal thing he does on his cases,” Townsend said. “The parties advised him that we needed to move forward to try and get (the lawsuit) resolved. When he heard the dispute wasn’t resolved yet, he wanted to set the wheels in motion to get it resolved.”
